New Mexico Contractor Caught Misclassifying Electrical Workers

The New Mexico Chapter of National Electrical Contractors Association (NECA) and IBEW Local 611 found evidence of job misclassifications on a construction project at the Lincoln County Medical Center by VA Electric contractors. Concerns about these job misclassifications were reported to Torres Consulting and Law Group’s compliance team for further investigation.

TCLG found that eight employees were misclassified from June 2018 through November 2019. Job misclassifications are not an uncommon practice by contractors, but unless its reported, it often leaves workers underpaid.

TCLG sent their evidence of job misclassifications to the New Mexico Labor Relations Division, which found that the affected eight workers were owed $2,575.00 in backpay wages. In addition, VA Electric committed multiple violations of the New Mexico Public Works Minimum Wage Act (PWMWA).

Thanks to the efforts of the New Mexico Chapter of NECA, IBEW Local 611, and TCLG’s compliance team, workers received their correct earned wages and the contractor in charge was held accountable for their actions.
